Introduction

This privacy policy (this “Privacy Policy” or “Policy”) governs the manner in which iShopShops, Inc. (“ShopShops,” “we,” “our,” “us” and similar terms) collects, uses, maintains and discloses information collected from users who register on or through its websites, software applications or mobile applications (collectively, the “Service”).

In this Policy, “user” or “you” means any individual using the Service.

What Information Do We Collect?

Personal Information: We may collect certain personal information about you in connection with your use of the Service, including: (a) when you register to use the Service, we may collect the personal information through our online registration form, such as your first name, last name, email address, mailing address, phone number, username, password and other information detailed therein; (b) if you pay your fees by credit card, we (or a third-party payment processor acting on our behalf) will collect the name, expiration date and credit card number for the relevant card; (c) if you communicate with us by email but do not otherwise register to use the Service, we will collect your email address; (d) commercial information including information about your purchases and Services you have shown interest in; and (e) if you apply for employment with us, we will collect personal information related to your potential employment, including your education and employment history, address and contact information, demographic information, and any other information included in your resume or application. All of this information is referred to in this Policy as “Personal Information.” If you contact ShopShops or another user and disclose additional personal information, we may store that information.

From time-to-time, we may offer functionality on the Service permitting you to connect the Service to your Facebook, Twitter, Instagram or other social media accounts (your “Social Media Accounts”) or messaging services (your “Messaging Service Accounts”). If you choose to connect your ShopShops account with any Social Media Accounts or Messaging Service Accounts, we may access and collect certain personal information (such as your name and email address) that your privacy settings on such Social Media Accounts and Messaging Service Accounts permit us to access.

Web Tracking Information: We and our Service Providers (defined below) may use web tracking technologies such as pixel tags and clear GIFs in order to operate the Service efficiently and to collect data related to usage of the Service. Such collected data (“Web Tracking Information”) may include the address of other websites you have visited, the type of browser you are using, your Internet Protocol (IP) address, device model, device ID and other unique device identifiers, what pages in the Service you visit and what links you clicked on, and whether you opened email communications we send to you. We and our Service Providers may also use web tracking technologies that are placed in web pages on the Service or in email communications to collect information about actions that users take when they interact with the Service or such email communications. We do not correlate Web Tracking Information to individual user Personal Information. Some Web Tracking Information may include data, such as IP address data, that is unique to you. We use this information not to identify individual users, but to analyze trends, administer the Service, track users’ movements around the Service, and gather demographic information about our user base as a whole which provides us with the ability to determine aggregate information about our user base and usage patterns. How Do We Collect Information

Directly From You – We collect Personal Information that you provide to us directly, for example, if you choose to contact us, request information from us, sign up to receive updates, or otherwise utilize our Site or Services.

From Third Parties – We may collect Personal Information from third parties, including but not limited to business partners, advertising networks, social networks, data analytics providers, mobile device providers, Internet or mobile service providers, recruiters and job application portals, and background check providers.

Through Online Tracking Technologies – We use cookies and similar technologies to collect Personal Information automatically as you navigate our Site. For additional information regarding our use of these technologies, see the Cookies and Tracking Technologies section below.

How Do We Use the Information We Collect?

Personal Information: We will use and store your Personal Information for the purpose of delivering the Service, and to analyze and enhance the operation of the Service. We may also use your Personal Information for the internal operational and administrative purposes of the Service.

If you make purchases on or through the Service, we may use any Personal Information you provide to fulfill your order and for one-time and recurring billing purposes according to the terms pertaining to such order. If we (or our payment processor) have trouble processing an order, such information may be used to contact you. Payment card information is sent in an encrypted format and is used only to send to our payment card processor, for the purposes of collecting payment for products or services ordered. We never make this information visible to anyone other than our payment card processor and never communicate it over a non-encrypted connection. The full payment card number is never seen by anyone inside our company, once entered and submitted, except by the payment card processor for the purposes of authorizing, clearing and reversing charges to your payment card.

Web Tracking Information: We use Web Tracking Information to administer the Service and to understand how well the Service is working, to store your user preferences, and to develop statistical information on usage of the Services. This allows us to determine which features visitors like best to help us improve the Service, to personalize your user experience, and to measure overall effectiveness.

Aggregate and De-Identified Information: We will also create statistical, aggregated and/or de-identified data relating to our users and the Service for analytical and commercial purposes. Aggregated and/or de-identified data is derived from Personal Information but in its aggregated and/or de-identified form, it does not duplicate or reveal any Personal Information or relate to or identify any individual. This data is used to understand our customer base and to develop, improve and market our services.

Customer Reviews: We may post user reviews or testimonials (“Reviews”) to the Service, and may use Reviews in other formats consistent with consent received. Reviews may contain personally identifiable information. We may use your Personal Information to contact you to obtain a Review and obtain your consent via email or agreement sent via fax, pdf or mail prior to using such Review and/or using your name along with your Review.

Legal Exception: Notwithstanding the above, we may store and use Personal Information to the extent required by law or legal process, to resolve disputes, to enforce our agreements (including this Privacy Policy and the Terms of Service) with you, or if in our reasonable discretion use is necessary to protect our legal rights or to protect third parties.

Promotional Communications: If you register and provide your email address, we may send you administrative and promotional emails.

Account Closure: If any of your account information appears to be incorrect, please contact us and let us know. If you close your account, we will delete any Personal Information associated with your account, but other information you submitted that is not associated with you personally may not be deleted.

How We Disclose Information?

We may disclose your Personal Information with your consent or in the following circumstances:

Affiliates and Subsidiaries: We may share Personal Information within our family of companies for their and our business and marketing purposes, including providing you with information about the Services we think may be of interest to you.

Service Providers: We disclose your Personal Information with the service providers that we use to support our business, including but not limited to, data analytics providers, website hosting providers, and other technology providers. If you are applying for a job with us, this may include service providers such as background check providers and human resource providers.

Business Partners: We may disclose Personal Information with trusted business partners. For example, we may disclose your Personal Information with a company whose products or services we think may be of interest to you or who we co-sponsor a promotion or service with. 

Ad Tech Companies and Other Providers: We may share or make available limited Personal Information (such as a mobile device identifiers) with ad tech companies and other online service providers. When we share your Personal Information in this context, we follow applicable legal requirements, which may require that we provide opt-out rights or other individual rights.

Legal Obligation or Safety Reasons: We may disclose Personal Information to a third party when we have a good faith belief that such disclosure of Personal Information is reasonably necessary to (a) satisfy or comply with any requirement of law, regulation, legal process, or enforceable governmental request, (b) enforce or investigate a potential violation of any agreement you have with us, (c) detect, prevent, or otherwise respond to fraud, security or technical concerns, (d) support auditing and compliance functions, or (e) protect the rights, property, or safety of ShopShops, its employees and clients, or the public against harm.

Merger or Change of Control: We may disclose Personal Information to third parties as necessary if we are involved in a merger, acquisition, or any other transaction involving a change of control in our business, including but not limited to, a bankruptcy or similar proceeding. Where legally required, we will give you notice prior to such disclosure.

Other: We may disclose Personal Information to third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

Cookies and Tracking Technologies

We and our service providers may use cookies and similar technologies to collect usage and browser information about how you use our Services. The technologies we use for this automatic data collection may include cookies and web beacons that permit us to verify system and server integrity and generate statistics around the popularity of certain content. We process the information collected through such technologies, which may include or be combined with Personal Information, to help operate certain features of our Services, to enhance your experience through personalization, and to help us better understand the features of our Services that you and other users are most interested in.

Website Delivery and Appearance: We may use third party providers to enable certain customer interaction opportunities, content delivery (like audio or video), or other service capabilities. Examples include, but are not limited to, the following functionality:

Content Delivery: We partner with service providers to host our Site and deliver specific content in support of our services. For example, we use Google Fonts to serve fonts on our Site. For more information about how Google collects and uses your data, visit Googles Privacy Policy.

 

Online Store: We may also provide a store hosted by Shopify through which you can purchase certain products. Information you provide through the Shopify store will be shared with Shopify to operate the store and fulfill orders. Website Analytics:We use analytics services, that use cookies and other technologies that collect your Personal Information, to assist us with analyzing traffic and site usage to optimize, maintain, and secure our Services and inform subsequent business decisions (including, e.g., advertising). These include, but are not limited to, the following third-party services:

Google Analytics: To learn more about how Google uses data, visit Googles Privacy Policy and Google’s page on “How Google uses data from sites or apps that use our services.” You may download the Google Analytics Opt-out Browser Add-on for each web browser you use, but this does not prevent the use of other analytics tools. Meta and TikTok Pixels: We use Meta and TikTok pixels to track user activity on our Services and improve downstream offerings, including interest-based advertising for our services and those of our partners and service providers.

 

Interest-Based Advertising:We may also allow or enable third parties to collect Personal Information to provide their interest-based advertising on behalf of our products and services, or their own. Interest-based advertising occurs when advertisements are shown to you based on information collected from your online interactions over time and across multiple websites, devices, or online services that you visit or use. Some companies may engage in cross-context behavioral advertising to predict your preferences and show you advertisements that are most likely to be of interest or relevant to you.We do not control these third parties' collection or use of your information for these purposes, or the opt-out options they may individually offer you via their terms, conditions, and privacy policies. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. Examples of the third-party service providers we engage to serve interest-based advertisements include Google Ads (including Google Dynamic Remarketing, Google AdWords Conversion, and Google Tag) and Meta Ads (including Meta Pixels, Facebook Custom Audience, and Facebook advertising services).

Selling or Sharing Personal Information: While we do not sell Personal Information in exchange for monetary consideration, we do share Personal Information for other benefits that could be deemed a “sale” or “sharing” under various data protection laws, because they are sometimes broadly defined to include activities such as the delivery of interest-based advertising on websites or allowing third parties to receive certain information, such as cookies, IP address, and/or browsing behavior. We similarly engage in interest-based advertising when we use data about your activities on our Services to serve you ads on websites owned or controlled by third parties. It is in this context that we have provided advertising networks, data analytics providers, social networks, and video sharing platforms with Personal Information such as your IP address, device information, Internet and other electronic network activity information, and geolocation information in the last twelve months.

Cookie Choices – To manage your preferences with respect to these technologies, you can:

Visit our cookie management platform, or customize your browser settings to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable certain cookies, please note that some parts of our Services may not function properly. These settings may be lost and require reconfiguration if you delete your cookies.

Block the collection and use of your information by online platforms and ad tech companies for the purpose of serving interest-based advertising by visiting the opt out pages of the self-regulatory programs of which those companies are members: National Advertising Initiative and Digital Advertising Alliance. Please note that even if you opt out of interest-based advertising, you may still see “contextual” ads which are based on the context of what you are looking at on the websites and pages you visit.

Review and execute any provider-specific instructions to customize your preferences or opt-out of certain processing, including interest-based advertising, by third party service providers. For example, to opt-out of this type of advertising by Google, customize your ad preferences, or limit Google’s collection or use of your data, visit Googles Safety Center and Googles Ad Settings and follow Googles personalized ad opt-out instructions. Meta also offers an Ad Preferences center to customize your settings, as well as a Privacy Policy with additional information on how you can exercise your rights.

 

Your Choices

Depending on where you live, you may have the following rights with respect to your Personal Information:

Access: The right to request access to and obtain a copy of any Personal Information we may have about you.

Deletion: The right to delete your Personal Information that we have collected or obtained, subject to certain exceptions.

Correction: The right to request that we correct any inaccuracies in your Personal Information, subject to certain exceptions.

Opt Out of Certain Processing: The right to: (a) opt out of the processing of your Personal Information for purposes of targeted advertising, (b) opt out of the sale or sharing of your Personal Information; (c) limit the use of your sensitive Personal Information (if applicable), and (d) opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. We do not collect or process sensitive Personal Information outside of purposes permitted by law (such as section 7027(m) under the California Consumer Privacy Act Regulations), so we do not offer the option to limit its use. We also do not profile you or other individuals in a manner that would result in legal or similarly significant effects, so we do not offer an opt out.

Please note that, even if you unsubscribe from certain correspondence, we may still need to contact you with important transactional or administrative information, as permitted by law. Additionally, if you withdraw your consent or object to processing of your Personal Information, or if you choose not to provide certain Personal Information, we may be unable to provide some or all of our services to you.

You may exercise your opt out rights by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC). We honor Opt-Out Preference Signals, including GPC. If you choose to use an Opt-Out Preference Signal, you will need to turn it on for each supported browser or browser extension you use.

We must verify your identity before fulfilling your requests. If we cannot initially verify your identity, we may request additional information to complete the verification process. We will only use Personal Information provided in a request to verify the requestor’s identity. If you are an authorized agent making a request on behalf of a California consumer, we will also need to verify your identity, which may require proof of your written authorization or evidence of a power of attorney. We endeavor to respond to requests within the time period required by applicable law. If we require more time, we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically.

We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us.

We may deny certain requests, or only fulfill some in part, as permitted or required by law. For example, if you request to delete Personal Information, we may retain Personal Information that we need to retain for legal purposes.

Only you, or an authorized agent that you authorize to act on your behalf, may make a request related to your Personal Information.

You will not be discriminated against in any way by virtue of your exercise of the rights listed in this Policy which means we will not deny goods or services to you, provide different prices or rates for goods or services to you, or provide a different level or quality of goods or services to you.

General

Security: We use reasonable security precautions to protect the security and integrity of your Personal Information in accordance with this Policy and applicable law. However, no Internet transmission is completely secure, and we cannot guarantee that security breaches will not occur.

Without limitation of the foregoing, we are not responsible for the actions of hackers and other unauthorized third parties that breach our reasonable security procedures.

Retention: We retain your information for as long as needed: (i) to conduct business with you; (ii) fulfill the purposes outlined in this policy; and (iii) to comply with our legal obligations, resolve disputes, and enforce any agreements.

Criteria we will use to determine how long to retain your Personal Information include the nature and length of our business relationship with you; our legal rights, obligations, and retention requirements; and if we have an ongoing business purpose for retaining your Personal Information, such as communicating with you about ongoing or prospective Services you requested.

Links: The ShopShops Service may contain links to other websites, including websites owned and operated by retailers, brands and other commercial partners. ShopShops is not responsible for the privacy practices or the content of those websites. Users should be aware of this when they leave the Service and review the privacy statements of each third-party website. This Privacy Policy applies solely to information collected by the Service. We encourage our users to read the privacy policies of these other websites before proceeding to use them.

Amendments: ShopShops may modify or amend this Policy from time to time. If we make any material changes, as determined by ShopShops, in the way in which Personal Information is collected, used or transferred, we will notify you of these changes by email. Notwithstanding any modifications we may make, any Personal Information collected by ShopShops from you will be treated in accordance with the privacy policy in effect at the time such information was collected, unless we obtain your consent otherwise.

Children: ShopShops does not knowingly collect or maintain personally identifiable information from persons under 16 years of age, and no part of the Service is directed at persons under 16. If you are under 16 years of age, then please do not use the Service. If ShopShops learns that personally identifiable information of persons less than 13 years of age has been collected without verifiable parental consent, then ShopShops will take the appropriate steps to delete this information. Users from outside the United States: ShopShops and its servers are located in the United States and are subject to the applicable state and federal laws of the United States. If you choose to access the Service, you consent to the use and disclosure of information in accordance with this Privacy Policy and subject to such laws.

This Section applies to our collection and use of Personal Information if you are a resident of California, as required by the California Consumer Privacy Act of 2018 and its implementing regulations, as amended by the California Privacy Rights Act (“CCPA”), where “Personal Information” has the definition set forth in the CCPA.

We do not knowingly sell or share the Personal Information of minors under the age of 16.

Shine the Light. Under California Civil Code Section 1798.83, individual customers who reside in California and who have an existing business relationship with us may request information about our disclosure of certain categories of personal information to third parties for the third parties’ direct marketing purposes, if any. To make such a request, please contact us at service@shopshopslive.com. Please be aware that not all information sharing is covered by these California privacy rights requirements and only information on covered sharing will be included in our response. This request may be made no more than once per calendar year.
