ELIGIBILITY: The PARIS TRIP Giveaway Sweepstakes (the "Sweepstakes") is open to legal residents of the United States, excluding Rhode Island, who are 18 years of age or older. Employees, officers or directors of ShopShops (“Sponsor”), or any of its parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this Sweepstakes (collectively, the “Sweepstakes Entities”) are not eligible to participate. Void where prohibited.
SWEEPSTAKES PERIOD: The Sweepstakes begins on 06/01/2023 at 12:00 a.m. Eastern Time (“ET”) and ends on 06/30/2023 at 11:00 p.m. ET (the “Sweepstakes Period”). The Sponsor’s database computer is the official time-keeping device for this Sweepstakes.
HOW TO ENTER: During the Sweepstakes Period:
i. Primary Method of Entry: Complete the Primary Method of Entry by clicking "enter giveaway" within the ShopShops App or create an account and enter on any mobile web browser. Maximum one (1) entry per registered user. Any attempt to enter the Primary Method of Entry more than one (1) time via multiple names, email addresses, or any other means, may result in disqualification from this and any other promotional offerings from Sponsor.
ii. Bonus Entries: Once you have completed the Primary Method of Entry, you can earn up to three (3) bonus entries by referring new users. To refer new users, click on the giveaway, select the share button, and copy your unique link to send to friends. For each friend that registers a first time account with ShopShops, you will earn one (1) bonus entry, up to a maximum of three (3) bonus entries via this method.
Use of any macro, bot, script or other automated means to submit entries is prohibited.
WINNER SELECTION AND NOTIFICATION:
The winner[s] will be selected in a random drawing from among all eligible entries and will be announced during the 🇫🇷PARIS TRIP FOR TWO GIVEAWAY livestream hosted by the sweepstakes sponsor on 06/01/2023 at 10:00 p.m. ET To win, attend the designated livestream in the App, and tap “Check in” to confirm you are ready to win. To "Check in" via a web browser, login to your account (phone verification must be complete) and "Check in" at the designated livestream. Entries will be voided if participants do not attend and check in. The Winner will be selected by random drawing from all eligible entries. If you win, tap “Claim Prize” in the designated livestream. If the Winner does not claim the prize within twenty-four (24) hours, an alternate winner will be selected from all eligible participants. Any alternate winners will have twenty-four (24) hours to accept the prize, before another potential alternate winner is selected. The Sponsor’s database computer is the official time-keeping device for this Sweepstakes. No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. Failure to respond to any winner notification within the designated time results in disqualification and selection of an alternate winner. Judges’ decisions are final and binding in all matters relating to this Sweepstakes. Each winner may be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release (where legal) (“Prize Claim Documents”). If a potential winner fails to comply with Sponsor’s requests for Prize Claim Documents, is found to be ineligible, or cannot or does not comply with these Official Rules, he/she may be disqualified and the prize may be awarded to an alternate winner.
PRIZES/ODDS: One (1) winner of the Sweepstakes will win: a trip for the Sweepstakes Winner and his/her travel guest ("Guest") to Paris on a mutually agreed upon date. The Sweepstakes Prize includes: (i) roundtrip air transportation for Sweepstakes Winner and Guest departing from a major airport nearest the Sweepstakes Winner’s residence (as determined by Sponsor in its sole discretion) to Paris, France (Approximate retail value ("ARV"): ($2,750.00 USD); (ii) hotel accommodations for three (3) nights in a standard room based on double occupancy (ARV: $1,500.00 USD); (iii) $500 cash for shopping (ARV: $500.00 USD); (collectively, the "Sweepstakes Prize"). Please note that ground transportation is not included. Prize is non-transferable and no cash equivalent or substitution of the prize is offered, except at the sole discretion of the Sponsor. Sponsor is responsible only for prize delivery and not prize utility. Sponsor reserves the right to substitute for the listed Sweepstakes Prize, or any portion thereof, one of comparable value if any advertised prize becomes unavailable for any reason. Each winner is responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize.
Odds: The odds of winning depend on the number of eligible entries.
TRAVEL CONDITIONS: Due to the nature of the Prize, the Potential Winner and Guest must be available to travel or the Sweepstakes Prize will be forfeited and an alternative Potential Winner may be randomly selected from all remaining eligible entries received, in Sponsor's sole discretion. If Sweepstakes Prize includes international travel, Potential Winner must possess the necessary travel documents (e.g., Passport) at the time of notification or the Sweepstake Prize will be forfeited and an alternative Potential Winner may be randomly selected from all remaining eligible entries received, time permitting, in Sponsor's sole discretion. The Guest must complete and return all requested liability, publicity (where permitted by law) and other consents, releases and/or other documentation prior to Sweepstakes Prize travel dates. Guest must be at time of prize fulfillment the age of majority in the jurisdiction in which they reside (and at least eighteen (18) years of age). In the event of cancellation or unavailability after travel has been booked, the remainder of the trip will be awarded as the complete Sweepstakes Prize. Allow up to 6-10 weeks after winner validation for delivery or arrangement for delivery of prize. Actual value may vary depending on departure and destination cities, dates of travel, and fluctuations in travel costs. Any difference between actual value and advertised value will not be awarded. Sponsor, in its sole discretion, shall determine which airport is closest to the Sweepstakes Winner's home. If Sweepstakes Winner resides within a 200-mile radius of destination city, Sponsor reserves the right to substitute round-trip ground transportation to/from Sweepstakes Winner's residence in lieu of air transportation. Sweepstakes Winner and Guest must travel together on the same itinerary. TRAVEL SUBJECT TO AVAILABILITY AND BLACKOUT DATES. Sweepstakes Winner and Guest are responsible for obtaining all necessary travel documents including but not limited to all necessary photo IDs, passports and other documents required for travel. Travel arrangements must be made through Sponsor's designated agent and on an airline carrier of Sponsor's choice. If Sweepstakes Winner elects to travel or participate in the Sweepstakes Prize travel without a Guest, no additional compensation will be awarded. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of Sponsor. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by Sponsor's airline carrier of choice as detailed in the passenger ticket contract. The passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to the Sweepstakes Winner's and their Guest's transportation and such contracts shall be solely between the Sweepstakes Winner, their Guest and such transportation companies. Lost, stolen, mutilated or damaged airline or other tickets, vouchers and certificates will not be replaced or exchanged. No stopovers are permitted on tickets issued as part of the Sweepstakes Prize. If a stopover occurs, the prize travel will terminate and Sweepstakes Winner and their Guests will be responsible for the full fare that will be charged from the stopover point for the remaining trip segment(s), including the return. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any air carrier(s) or other transportation companies or any other persons providing any of these services to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sweepstakes Winner is solely responsible for charges or fees for any elective supplements or changes, including but not limited to ticket changes, cabin upgrades, elective departure or arrival date changes, inflight amenities, early check-in and/or late check-out, incidental charges, or room upgrades. Airline tickets issued in connection with the prize may not be eligible for frequent flier miles or upgrades. Sweepstakes Winner and Guest(s) must comply with all hotel check-in requirements, including, but not limited to, the presentation of a payment card for incidental expenses, which are the responsibility of Sweepstakes Winner. Air transportation and hotel accommodations must be taken together and cannot be taken separately. Additional restrictions, conditions and limitations may apply. Sponsor is not responsible if the Sweepstakes Winner does not use any event tickets on day of the applicable event.
ADDITIONAL RULES: Acceptance of a prize constitutes winner’s permission for Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation except where prohibited by law. By participating, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the judges, which are final and binding in all matters relating to the Contest. Failure to comply with these Official Rules may result in disqualification from the Contest. Entry materials/data that have been tampered with or altered are void. No responsibility is assumed for: (i) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, mobile device, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems; or (iii) any injury or damage to entrant's or any other person's mobile device related to or resulting from participating in the Contest. Sponsor reserves the right to: (i) permanently disqualify from any promotion it sponsors any person it believes has intentionally violated these Official Rules; and (ii) suspend, modify or terminate the Contest if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper conduct of the Contest. Any individual who is found to be tampering with the entry process or the operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, may be disqualified, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
RELEASE OF LIABILITY: By participating in the Sweepstakes, you (and if you are a minor, your parent or legal guardian) agree that the Sweepstakes Entities (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from acceptance, awarding, receipt, possession and/or use or misuse of any prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Nothing in these Official Rules limits or excludes the liability of the Sponsor for fraud or for death or personal injury caused by the negligence of the Sponsor. By participating in the Sweepstakes, you further agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (c) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses. These rules and any disputes relating hereto are governed by the internal laws of the State of New York without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in New York for resolution of any disputes relating to the Sweepstakes and waive any objection thereto. For New Jersey Residents: Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.
DATA: By entering, you agree to Sponsor’s manner of collection and usage of any personal information you submit, all of which is subject to Sponsor’s privacy.
INSTAGRAM: By participating, you release Instagram, and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram.
